Regulation 17 - Foul Play

Regulation 17 addresses issues of foul play that takes place on the rugby pitch. Commonly known as yellow and red cards, these are for infringments of the Laws of Rugby, when called out by the referee during the match.

Process

After the referee reports their cards from a match, Rugby Indiana collects all the player information, and then forwards that information and the card report to the Disciplinary Chairperson. 

The Disciplinary Chairperson then assigns the report and information to a Judicial Officer, which can be the chairperson. 

The Judicial Officer will contact the head coach, and have a pre-hearing. At the pre-hearing the coach will learn the process for the hearing, who can attend (player and a parent/guardian really should be at the hearing), how/when to submit evidence for the hearing, answer process questions, and set the date and time for the hearing. 

At the hearing they will review the referee report and additional evidence from the referee (if submitted), and the player can tell the Judicial Officer (JO) their side of the events.   The JO decides if the event meets the red card test, and then it does, uses World Rugby Regulation 17, Appendix 3 to set the applicable sanction.

Appeals

  • All parties of an initial hearing have the right to appeal the decision. 

Appeal hearings are NOT a second hearing of the case. The Appeal Officer/Committee will have access to any files of the first hearing and ordinarily do not re-hear witnesses or accept new evidence unless there are exceptional circumstances. Instead, the onus in an appeal is on the party appealing (the appellant) to prove that (20.8.5):

  • The Judicial Officer/Disciplinary Committee’s decision was in error in fact or law,
  • Should be overturned in the interests of justice,
  • The sanction was manifestly excessive or wrong in principle, or
  • The sanction was unduly lenient.

If the appellant can convince the Appeal Officer/Committee of one of the above failings in the Judicial Officer/Disciplinary Committee’s decision, then the appeal will be allowed and the Appeal Officer/Committee will issue a new decision/ sanction in line with the process.

Process

An appeal must be filed with the Judicial Officer by the deadline outlined in their wwritte decision (usually 72 hours).   In Indiana, an appeal form must be complete along with the bond payment (refundable if the appeallant wins). 

The appeal must state SPECIFICALLY on which of
these provisions the appeal would be based, providing a brief statement of how the DC/JO allegedly erred
regarding each subsection of the Reg.
